La Corte Suprema de Justicia de Colombia ha establecido un importante fallo (SC2429-2024) que marca un precedente sobre la disolución de la sociedad conyugal en el país. Según este fallo, cuando una pareja lleva más de dos años separada de cuerpos, es decir, viviendo en domicilios distintos, pero sin haber formalizado un divorcio, la sociedad conyugal podría disolverse automáticamente.
Este concepto jurídico tiene implicaciones profundas para los derechos patrimoniales de los cónyuges y las relaciones legales con sus nuevas parejas.
¿Qué implica la separación de cuerpos?
En Colombia, la separación de cuerpos es un proceso legal que permite a los cónyuges vivir de manera independiente sin perder su estatus de casados. Sin embargo, aunque la convivencia física cesa, no significa que la sociedad conyugal se disuelva automáticamente.
De acuerdo con el Código Civil Colombiano, la sociedad conyugal continúa vigente hasta que un juez decreta el divorcio o hasta que se realice la liquidación de la misma tras la muerte de uno de los cónyuges. En este contexto, el cónyuge sobreviviente es el primer llamado a recibir pensión de sobreviviente o incluso a reclamar como heredero.
La separación de cuerpos no disuelve la sociedad conyugal, por lo que los derechos patrimoniales siguen siendo compartidos. No pueden coexistir dos sociedades conyugales al mismo tiempo”, explica Jimmy Jiménez, abogado del bufete Integrity Legal.
El fallo de la Corte Suprema
Sin embargo, la reciente sentencia de la Corte Suprema de Justicia (SC2429-2024) ha cambiado esta perspectiva. El tribunal ha interpretado que una separación de cuerpos que se prolongue por más de dos años puede dar lugar a la disolución de la sociedad conyugal de manera automática, siempre y cuando no exista una oposición formal por alguna de las partes.
Esta decisión, aunque no establece una jurisprudencia vinculante en todos los casos, ofrece una interpretación novedosa y podría proteger los derechos del nuevo núcleo familiar, especialmente en situaciones donde una de las partes ya ha iniciado una nueva relación de convivencia.
Implicaciones para los Derechos Patrimoniales
Una de las consecuencias más relevantes de este fallo es que, si se considera disuelta la sociedad conyugal, los bienes adquiridos durante el matrimonio podrían dejar de ser considerados parte del patrimonio conjunto. En teoría, cada cónyuge podría disponer de sus bienes de manera individual, lo que facilita la administración de propiedades y activos sin la intervención del otro cónyuge.
Esto es crucial para aquellas parejas que deciden no formalizar el divorcio, pero que, a pesar de estar separadas, siguen siendo legalmente responsables uno del otro en cuanto a bienes comunes.
Además, el fallo afecta directamente la relación patrimonial entre los cónyuges y sus nuevos convivientes. En el caso de que uno de los cónyuges inicie una nueva relación, no podría establecer una nueva sociedad conyugal mientras no se liquide adecuadamente la anterior.
Esta situación podría generar conflictos legales sobre la administración y distribución de los bienes adquiridos en el nuevo núcleo familiar.
¿Qué pasa en este caso con la pensión de sobreviviente?
Otra de las implicaciones de esta sentencia está relacionada con las pensiones de sobreviviente. Actualmente, tanto la esposa como la compañera permanente pueden reclamar pensión, pero siempre bajo ciertas condiciones, como la convivencia y el cumplimiento de los requisitos legales establecidos.
El fallo de la Corte podría complicar la situación de aquellas parejas separadas, pero que aún no han formalizado su divorcio. Dependiendo de la interpretación del juez en cada caso, el cónyuge sobreviviente podría perder ciertos derechos patrimoniales si la sociedad conyugal se considera disuelta de manera automática.
El abogado Jimmy Jiménez señala que esta sentencia podría abrir la puerta a una posible reforma del Código Civil Colombiano, ya que genera incertidumbre en la aplicación de los derechos patrimoniales, especialmente en cuanto a la liquidación y disolución de la sociedad conyugal. “Aunque el Código Civil no ha sido modificado para reflejar esta interpretación, es un fallo que invita a repensar la normativa actual”, concluye.
Esta nueva realidad jurídica plantea la necesidad urgente de revisar los procedimientos legales en torno al divorcio y la sociedad conyugal, a fin de evitar futuras controversias legales sobre la propiedad, herencias y pensiones.
