El Consejo Nacional Electoral (CNE), ente encargado de supervisar a los partidos y campañas políticas en Colombia, abrió una investigación preliminar contra el expresidente Álvaro Uribe por presuntas irregularidades en su candidatura al Senado para las elecciones de 2026, debido a su proceso judicial que podría inhabilitarlo.
Origen de la investigación y fundamento jurídico
Según un auto difundido este sábado por el ciudadano Inder Ramírez, quien interpuso el escrito de impugnación ante el CNE, la investigación se origina tras la sentencia en primera instancia que condenó a Uribe a 12 años de cárcel domiciliaria por un caso de sobornos.

En la decisión, con fecha del 8 de octubre, el CNE resuelve “decretar la apertura de la indagación preliminar” hasta que se formalice la inscripción definitiva de la candidatura de Uribe para las elecciones legislativas del 8 de marzo de 2026, con el fin de “revisar la eventual configuración de la causal revocatoria”.
El organismo recordó que, según la Constitución, “aquellas inscripciones de candidatos que se encuentren incursos en causal de inhabilidad serán revocadas” por el CNE.
La carta magna, sostiene el documento, establece que no podrán ser congresistas “quienes hayan sido condenados en cualquier época por sentencia judicial a pena privativa de la libertad, excepto por delitos políticos o culposos.”
Antecedentes y condena al expresidente
Uribe, quien antes de llegar a la Presidencia (2002-2010) fue senador, gobernador de Antioquia (noroeste) y alcalde de Medellín, se convirtió en agosto pasado en el primer expresidente colombiano condenado penalmente, tras ser hallado culpable de soborno en actuación penal y fraude procesal.
La jueza Sandra Heredia, a cargo del llamado ‘juicio del siglo’ en Colombia, condenó al político de 73 años y líder del partido Centro Democrático a 12 años de prisión domiciliaria y lo inhabilitó para ejercer funciones públicas por más de ocho años.

Sin embargo, el Tribunal Superior de Bogotá le concedió luego la libertad hasta que se resuelva en segunda instancia la apelación presentada por su defensa. La decisión se conocerá el próximo martes 21 de octubre.
Reacciones y repercusiones políticas
Tras conocer la apertura de la indagación preliminar, Ramírez celebró en la red social X este “triunfo” que, según él, “demuestra que ningún poder político está por encima de la Constitución ni de la Justicia.”
El caso: de Iván Cepeda al juicio del siglo
El caso contra Uribe se remonta a 2012, cuando el entonces senador demandó al legislador de izquierdas Iván Cepeda ante la Corte Suprema de Justicia por presunta manipulación de testigos, mientras Cepeda preparaba una denuncia en el Senado contra él por supuestos vínculos con grupos paramilitares.
La Corte no solo decidió no investigar a Cepeda, sino que abrió un proceso contra Uribe al encontrar indicios de que manipuló testigos para evitar que lo relacionaran con el paramilitarismo.
Contexto electoral y futuro político
Pese al fallo condenatorio, Uribe continúa participando activamente en la vida política colombiana, mientras el país se adentra a la campaña electoral para las elecciones del próximo año.
Las presidenciales serán el 31 de mayo y, de ser necesaria, habrá una segunda vuelta el 21 de junio.
